Fair recovery is one of the core protections on our borrower rights checklist. Our guide to the loan recovery process in India explains the stages a lender follows after a default. This post is narrower and more practical: what an agent can and cannot do on the phone and at your door, what changes on 1 January 2027, and exactly what to do, minute by minute, if an agent crosses the line.
How the rules got here
RBI rules on recovery agents: key dates
Based on the RBI’s August 2022 circular on recovery agents and the RBI (Non-Banking Financial Companies – Responsible Business Conduct) Third Amendment Directions, 2026, dated 6 August 2026; parallel amendments were issued for commercial banks. Dates as of October 2026.
Two things follow from that timeline. First, the core protections are already in force today: since 2022, the RBI has barred regulated lenders’ agents from calling before 8 am or after 7 pm, and from intimidating, humiliating or harassing borrowers, their families, referees and friends. Second, from 1 January 2027 the rules add paperwork and accountability that make violations much easier to prove.
What applies now, and what changes on 1 January 2027
| Protection | Today (October 2026) | From 1 January 2027 |
|---|---|---|
| Calling hours | 8 am to 7 pm only | 8 am to 7 pm, unless you ask for another time, which must be honoured |
| Threats, abuse, public shaming | Prohibited, including inappropriate messages on phone or social media | Prohibited, within a written code of conduct agents must follow |
| Family, friends, colleagues | No harassment or intrusion on their privacy | Agents deal only with the borrower or guarantor |
| Notice before a visit | Lender’s fair practices code | Agency details sent to you at least one day before an in-person visit |
| Agent’s identity | Lender’s policy | ID card, the lender’s authorisation letter and a copy of the notice sent to you |
| Call recording | Varies | Calls recorded, you are told, recordings kept at least six months |
| Sensitive occasions | Expected under fair practice | No calls or visits during a bereavement, medical emergency, calamity or wedding |
| Agency transparency | Varies | Lender publishes its recovery agencies on its website; you are told if the agency changes |
| Training | Lender’s responsibility | Agents must hold a recognised Debt Recovery Agent certificate |

What an agent can and cannot do
An agent can
- Call you between 8 am and 7 pm to remind you of dues
- Visit, with prior notice, carrying ID and the lender’s authorisation
- Tell you, accurately, the amount overdue and the consequences the law allows
- Discuss a repayment plan and pass your proposal to the lender
- Collect payment through the lender’s official channels, with a receipt
An agent cannot
- Call before 8 am or after 7 pm, or make anonymous or threatening calls
- Use abusive language, threats of violence or false threats of arrest
- Message or call your relatives, colleagues or contacts to embarrass you
- Post about you on social media or in groups
- Ask you to pay into a personal UPI ID or bank account
- Seize property without following the legal process
An agent is at your door: the 5-minute check
Ask for three documents
An identity card, the lender’s authorisation letter, and (from 2027) the notice the lender sent you. No documents, no conversation about money.
Match the agency
Check the agency’s name against the lender’s website or call the lender’s official customer-care number, not a number the agent gives you.
Never pay cash to a stranger
Pay only through the lender’s app, website, bank transfer to the lender’s account, or a counter receipt on the lender’s letterhead.
Keep it short and factual
Acknowledge the dues, say you will contact the lender in writing, and ask the agent to leave if they become abusive.
Write it down the same day
Date, time, names, what was said, and photos of any documents shown.
“I acknowledge the dues and will write to the lender today with a repayment proposal. Please share your ID and authorisation letter. I won’t discuss this outside 8 am to 7 pm.”
Keep a recovery contact log
Evidence turns a frustrating experience into a complaint that gets resolved. A simple log, kept in your notes app, is enough:
| Date and time | Number or name | Call / visit / message | What was said | Breach? |
|---|---|---|---|---|
| 12 Nov, 8:40 pm | +91 9xxxx xxxxx | Call | Threatened to inform my office | After 7 pm; third-party threat |
| 13 Nov, 11:10 am | Agent “R”, ABC Agency | Visit | No ID shown, demanded cash | No authorisation; cash demand |
Illustrative entries. Save screenshots of messages and call logs alongside the log.
If an agent crosses the line
If the “agent” is from an unregistered loan app rather than a regulated lender, the playbook is different. Read our guide to fake loan app harassment first.
The rules protect you. They don’t erase the loan.
Fair-recovery rules stop harassment; they don’t cancel the debt, stop interest or penal charges, or prevent the lender from using legal remedies such as a civil suit. Unpaid EMIs also show up on your credit report, and with credit bureaus now updated four times a month, that happens faster than before (see our guide to weekly credit reporting). The calmest way to end recovery calls is a written repayment plan. Our guide on personal loan default and the law explains your options.
If the calls are coming from several loan apps at once, the real problem is usually rollover fees that never touch the principal. Omozing SmartSwitch can replace several short-term app loans with one personal loan and one EMI: the money goes to your own account, you close each app loan, and you repay a single instalment that actually ends.

Frequently asked questions
What time can loan recovery agents call in India?
Agents of RBI-regulated lenders may contact borrowers only between 8 am and 7 pm. This has applied since the RBI’s August 2022 circular, and the 2026 directions, effective 1 January 2027, keep the window while letting you ask for a different time.
When do the new RBI recovery agent rules start?
The RBI issued the amendment directions on 6 August 2026 and they take effect on 1 January 2027. Existing protections against harassment and calls outside 8 am to 7 pm already apply today.
Can a recovery agent call my family or office?
Agents must not harass or intrude on the privacy of your family, referees, friends or colleagues. Under the 2026 directions, agents deal only with the borrower or guarantor.
Must a recovery agent give notice before visiting?
From 1 January 2027, the lender must send you the recovery agency’s details at least one day before an in-person visit, and the agent must carry an ID card, an authorisation letter and a copy of that notice.
Can recovery agents come during a wedding or a death in the family?
Under the 2026 directions, there must be no calls or visits during a bereavement, medical emergency, calamity or marriage function in the family.
Where can I complain about recovery agent harassment?
Complain in writing to the lender’s grievance redressal officer first. If it is not resolved within 30 days, escalate to the RBI at cms.rbi.org.in. For threats or intimidation, contact the police, or call 1930 or use cybercrime.gov.in for threatening calls and messages.
