What does ‘wilful defaulter’ mean?

In short: A wilful defaulter is a borrower or guarantor who could pay but deliberately doesn’t, or who diverts or siphons off the borrowed money, with ₹25 lakh or more outstanding. Under the RBI’s 2024 Master Direction, a lender must first send a show-cause notice giving 21 days to respond, and a review committee must decide before anyone is classified. An ordinary salaried borrower who misses EMIs because they genuinely can’t pay is not a wilful defaulter. That is a default, which hurts your credit report, but it is a different and far less serious label.

The three tests a lender must clear

Can someone be called a wilful defaulter?

Test 1: is ₹25 lakh or more outstanding? Applies to borrowers and to guarantors Yes Test 2: was it deliberate? Able to pay, but chose not to, or diverted or siphoned off the borrowed money Yes Test 3: was due process followed? Show-cause notice with 21 days to respond, then a review committee decision Yes Yes to all three: may be a wilful defaulter No No No Not a wilful defaulter A missed EMI is still an ordinary default, and it still shows on your credit report

A simplified summary of the RBI Master Direction on wilful defaulters (2024). The lender has to establish each element; you get a chance to respond before any decision.

Notice what the label is really about: intent and capacity, not just non-payment. Someone who lost their job and couldn’t keep up with a large home loan has defaulted, but they haven’t chosen not to pay while able to. The rules are aimed at borrowers who had the means and walked away, or who used a loan for something other than its stated purpose and moved the money out of reach.

An ordinary default is serious enough on its own, and it is the one most people actually face. How long a default stays on your report and what “settled” means explain the routes back.

What most people get wrong: they believe a recovery agent who threatens to “declare you a wilful defaulter” over a ₹40,000 app loan. That can’t happen: the label needs ₹25 lakh or more outstanding, proof of deliberate non-payment and a formal process. Threats like this are a pressure tactic. Fair recovery rules apply to every regulated lender, and harassment can be reported to the lender’s grievance officer and then the RBI Ombudsman.

If you receive a show-cause notice

  1. Read it the day it arrives

You have 21 days to respond. Note the date and what the lender says you did.

  2. Gather proof of capacity and use of funds

Salary records, job-loss letters, medical bills and bank statements showing where the loan money went.

  3. Reply in writing, on time

Explain why non-payment wasn’t deliberate. A lawyer’s help is worth considering at this stage.

  4. Keep paying what you can

A repayment proposal backed by real numbers shows good faith and keeps the conversation open.

Frequently asked questions

Am I a wilful defaulter if I missed personal loan EMIs?

No, not just for missing EMIs. The label needs ₹25 lakh or more outstanding, deliberate non-payment despite being able to pay (or diversion of funds) and a formal process with a show-cause notice.

Can a guarantor be declared a wilful defaulter?

Yes. The rules apply to guarantors as well as borrowers, if the same conditions are met.

How much time do I get to respond?

The show-cause notice gives you 21 days to respond, and a review committee considers the case before any classification.

Is a wilful defaulter the same as an NPA?

No. An NPA is a loan overdue for more than 90 days, whatever the reason. Wilful default is a separate finding about deliberate non-payment or misuse of funds.

Can I get a personal loan after an ordinary default?

Often, once the dues are cleared and you have a run of on-time payments. Omozing considers salaried applicants with a score from 600, and a credit officer reads the full report.
